Re-sale properties are the most common way of purchasing a property in Spain. A re-sale property is purchased from a previous owner rather than direct from the developer, as in the case of new builds & off plan properties.
If you are purchasing a re-sale property, Freedom Gold Spain will arrange help in order to agree a preliminary contract with the vendor which commits them to sell it to you at the stated price within the terms of this contract. It is usual to pay a deposit at this time and the contract usually states that if you pull out of the sale you forfeit the deposit but if the vendor pulls out of the contact they are then liable to pay you back twice the amount of the deposit. The normal deposit is usually anything from 1 to 10% of the price.
After you have signed this contract, your lawyer will complete the checks before you sign the escritura (deeds). These checks include ensuring that there is no money owing on the property or that the property has been secured against. All household bills have to have been paid etc. This usually takes between 2 to 8 weeks (although it has been known to be completed in 5 days in extraordinary cases).
Completion of the property takes place at the Notary where the escritura is signed by the vendor & purchaser, the money is paid and the keys are handed over - finished.

Unlike the UK payment of a deposit secures the property and takes it off the market immediately.
